Legal / Terms

Clear terms. Clean data.

These terms govern access to DataAF. If we agree a separate written order, proposal or data-processing agreement, that document takes priority where it expressly differs.

The service

DataAF is operated by Leviathan Studios Ltd, company number NI710693. It provides website monitoring, source connections, normalised metrics, reports and team access. Features may evolve, particularly while access is limited or described as preview or beta.

Accounts and authority

Accounts are manually approved and may not be shared outside the authorised person or team. You must provide accurate information, keep access links and credentials secure, and promptly tell us about suspected misuse.

You confirm that you are authorised to connect each website, analytics property and third-party account.

Acceptable use

You must not probe or bypass security, access another customer's data, overload the service, upload unlawful material, infringe rights, introduce malicious code or use DataAF to collect sensitive form contents, passwords or payment-card data.

Customer data

You retain rights in data you provide or connect. You grant us the limited rights needed to host, process, back up and display it to provide and secure DataAF. You are responsible for your lawful basis, notices and consent choices on websites you control.

Third-party services

Google, Microsoft, Cloudflare and other connected services remain governed by their own terms and availability. DataAF preserves source definitions but cannot guarantee a provider's completeness, methodology or uninterrupted API access.

Intellectual property

DataAF, its design, code, documentation, branding and original content are owned by Leviathan Studios Ltd or its licensors. Except for normal use of the service, no rights are transferred. Third-party marks remain the property of their owners.

Availability and changes

We take reasonable care but do not promise uninterrupted or error-free operation. Maintenance, provider failures, security events and internet conditions can affect availability. We may change or discontinue features and will give reasonable notice where a material change affects active users.

Liability

Nothing excludes liability that cannot lawfully be excluded, including liability for fraud or fraudulent misrepresentation. Subject to that, DataAF is a decision-support tool: you remain responsible for business, marketing, compliance and technical decisions made using its outputs.

Any additional limits, fees, service levels or remedies will be stated in the applicable written agreement.

Suspension and ending access

We may suspend access where reasonably necessary to protect DataAF, another user or the public, or where these terms are materially breached. You may ask us to close an account and export or delete customer data, subject to legal retention and any written agreement.

Law and contact

These terms are governed by the laws of Northern Ireland, and its courts have jurisdiction, subject to any mandatory consumer rights that apply. Contact info@dataaf.lvthn.co before escalating a dispute so we can try to resolve it promptly.
